Court ruling: Driving ban after cannabis consumption – what applies now?

In Hamburg, the rules for drivers who consume cannabis are clear and the consequences can be significant. The Hamburg-Wandsbek district court recently decided a case that underlines the current laws. A 35-year-old man was given a one-month driving ban and a fine of 500 euros because he drove with a THC level of 12 nanograms per milliliter of blood - well above the limit of 3.5 nanograms that has been in force since August 22, 2024. The decision was made even though the man subsequently received a “cannabis card,” which did not meet the legal requirements because it did not contain any reference to a specific case of illness. Personal contact with a doctor is necessary in order to invoke the medication clause.

The fundamental decision, which illustrates the strictness of the new regulation, was made with reference to Section 24a (4) StVG, which came into force in April 2024. According to Haufe, adults now have the opportunity to possess up to 25 grams of cannabis in public spaces, while up to 50 grams in private spaces are exempt from punishment. However, a stricter limit of 1.0 nanograms of THC applies to novice and young drivers. These regulations are intended to ensure that road traffic remains safe, even in light of the changing use of cannabis.

Limit values and consequences for cannabis users

Driving under the influence of cannabis can result in hefty fines and the new regulations aim to increase road safety. Anyone who exceeds the limit must expect fines and possible driving bans. These regulations were not introduced without criticism. Many experts and politicians have commented on the severity of the new limit, and a comparison with countries such as Canada shows that a much stricter approach prevails here. In Canada, for example, the limit is 10 nanograms of THC per milliliter of blood serum.

It is important to emphasize that cannabis possession and use are still prohibited for minors and young adults are subject to additional restrictions. The debate surrounding the legalization and management of cannabis is in full swing as more and more people advocate responsible consumption and demand legal changes.

Health aspects and products

While the legal framework for cannabis in Germany is increasingly changing, the health and safety debate surrounding the topic of cannabis and THC remains current in society. Products like the BIODROGA Medical Institute SKIN BOOSTER 3% CBD Complex Serum from Biodroga could be an interesting alternative for many, as the CBD complex it contains promises a calming and balancing effect on the skin. After all, a little bit of well-being can’t do any harm – for your health! At a time when the use of cannabis is changing, the question remains how these changes will affect our everyday lives.

Whether used in road traffic or in the cosmetics industry – cannabis is an exciting topic that offers material for discussion for many. In Hamburg, everyone who likes to get behind the wheel should be aware of the consequences that driving under the influence of cannabis can have. The laws are clear – and so are the consequences!
